A fixed stamp duty of only Rs. 500 applies to the division of inherited property, according to a ruling issued by the Lahore High Court, rejecting a 2 percent levy.
Justice Tanveer Ahmad Sheikh approved a writ petition brought by citizen Muhammad Sajjad and released a written five-page verdict that serves as a judicial precedent.
Lower courts failed to provide legal backing for the 2 percent fee, the ruling stated. The court annulled the 2025 rulings from the civil judge and the additional sessions judge, establishing that the Stamp Act 1899 mandates a Rs. 500 duty on inheritance partitions.
Inclusion of other co-owners as parties in the litigation does not alter the character of the lawsuit, the court noted, adding that authorities cannot impose a percentage-based financial charge without statutory backing.
